IMPORTANT JUDGMENTS


1. Order passed by Hon’ble CAT, Madras Bench in O.A. No.1429/2012 on plotting of "Own Merit candidates".

The DP&AR had selected the candidates for the post of UDC during the year 2012 as per the guidelines of the DOPT, Govt. of India, O.M No.36012/13/88-Estt.(SCT), dated 22.05.1989 and O.M No.36011/1/98-Estt.(Res) dated 01.07.1998 which state that when relaxed standard is applied in selecting a SC/ST/OBC candidates, the SC/ST/OBC candidates are to be counted against reserved vacancies. Such candidates would be deemed as unavailable for consideration against unreserved vacancies. The selection was challenged in O.A. No.1429/2012. The Hon’ble CAT, Madras Bench held that the selection process was done as per law which needs no interference and dismissed the O.A.


2. Order passed by Hon’ble High Court in W.P No.28740 of 2015 and M.P No.1 of 2015 regarding fixing of cut-off date for age in the recruitment notification.

Applicant filed an O.A seeking direction to admit him by giving age relaxation for 20 days to become eligible for applying to the post of UDC citing the G.O. Ms. No.98/83-Lab dated 24.08.1983 issued by the Labour Department. The CAT, Madras Bench after considering the facts dismissed the O.A at the admission stage. Aggrieved on the order passed by the CAT, Madras Bench, the applicant filed a Writ Petition No.28740 of 2015 challenging the order passed by the Central Administrative Tribunal, Madras Bench, seeking for a direction to the respondents, to grant age relaxation, so as to enable the petitioner to apply to the post of Upper Division Clerk. The Hon’ble High Court upheld the order passed by the CAT, Madras Bench stating that "as rightly observed by the Central Administrative Tribunal, Madras Bench, Courts cannot issue any directions to the Appointing Authority, to grant any relaxation of age, contrary to Recruitment Rules, in which maximum age is prescribed."
